NAFTA Long-Haul Trucking Provisions

This Federal Motor Carrier Safety Administration (FMCSA) pilot program for U.S.-Mexico cross-border long-haul trucking will test and demonstrate the ability of Mexico-based motor carriers to operate safely in the U.S. beyond the municipalities and commercial zones along the U.S.-Mexico border. It is part of FMCSA's implementation of the North American Free Trade Agreement (NAFTA) cross-border long-haul trucking provisions.

U.S.- Mexico Cross Border Trucking Pilot Program - Summary:

  • Three-year pilot program
  • Carriers are subject to a phased approach before gaining permanent operating authority
    • Stage 1: Three-month evaluation includes a very thorough safety evaluation and inspections with each entry into U.S., and all drivers and vehicles must be approved by FMCSA
    • Stage 2: 18 month provisional operating authority, subject to regular inspections  and electronic monitoring
    • Stage 3: Permanent operating authority subject to successful comprehensive review after Stage 2
  • Reciprocity with Mexico – simultaneously comparable authority for U.S. and Mexican carriers
  • Previous demonstration program participants (from 2007-2009 pilot) given provisional operating authority “credit” with a few very close to eligibility for permanent operating authority
  • International cargo only and no point-to-point transport within U.S. – also excludes any hazmat
  • Electronic monitoring device to be installed in each vehicle for duration of pilot program enabling FMCSA/enforcement to track vehicle location and monitor driver hours

U.S.- Mexico Cross-Border Trucking Pilot Program - Pilot Operations Status:

Currently, 3 Mexico-domiciled motor carriers have been given active operating authority by FMCSA.  Their combined participation in the pilot to-date includes three vehicles, four drivers, and 15 trips across the border in six months since the pilot operation started in October 2011.
